Signed into law in 2023, the Montana Land Use Planning Act is a new state law that makes early and broad public participation a central and required part of local land use planning in Montana's largest cities. This law has prompted Columbia Falls, Kalispell, and Whitefish to not only update their Growth Policies, but to update their zoning codes as well to meet projected future housing needs over the next 20 years.
These updates are required to be completed by May 17, 2026.
Here’s the important part:
Once a land use plan is adopted after extensive public input, the public participation for a specific development project that largely follows that plan might be more limited. Public comments on these projects will be focused only on new or significantly increased impacts that weren't already considered during the initial planning process. This helps to create a more predictable and efficient process for everyone.
